Welcome to Frateca. These Terms of Service ("Terms") govern your use of the Frateca text-to-speech service available at app.frateca.com and through our iOS and Android applications (collectively, the "Service"), operated by Frateca ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Frateca is a text-to-speech service that converts written text into natural-sounding audio. The Service is available on the web, iOS, and Android platforms. Features and availability may vary by platform.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free and Pro Plans

Free Plan: Frateca offers a free tier with limited daily text-to-speech conversions. Free plan features and limits are subject to change at our discretion.

Pro Plan: The Pro plan offers expanded limits and premium features for a recurring subscription fee. Subscription pricing, billing cycles, and included features are displayed at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date.

Refunds: Subscription payments are generally non-refundable. For iOS and Android subscriptions, refund requests must be directed to Apple or Google respectively, per their refund policies.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Generate speech from content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service beyond normal usage patterns

We reserve the right to suspend or terminate your access for violation of these terms.

6. Intellectual Property

Our Content: The Service, including its design, features, code, and branding, is owned by Frateca and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Your Content: You retain ownership of the text you submit for conversion. By using the Service, you grant us a limited, non-exclusive license to process your text solely for the purpose of providing the text-to-speech conversion. We do not claim ownership of your content.

Generated Audio: Audio generated through the Service from your text may be used by you for personal or commercial purposes, subject to these Terms and any applicable third-party rights in the source text.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

To the maximum extent permitted by law, Frateca shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Frateca operates, without regard to conflict of law principles.
